Japan-based Nichia has announced the termination of legal proceedings for alleged patent infringement against Taiwan-based LED packaging service provider Harvatek in Germany because Harvatek has made monetary compensations.
Harvatek's white LED products coded HT-V116TW, HT-U158TW, HT-T169TW and HT-P178TWU-PQPS-DG for sale in Germany infringed on Nichia's YAG patent EP 936 682 (European Union, DE 697 02 929 in Germany), Nichia said, adding it had filed with the Dusseldorf District Court in Germany a charge against Harvatek, requesting for ban on sale of the infringing products and damages.
The district court upheld Nichia's claim in the first instance on March 29, 2012. However, Harvatek appealed the decision to the Dusseldorf Court of Appeal, which returned a verdict in favor of Nichia on January 20, 2017, Nichia indicated.
